PLEASE NOTE:  THIS SITE OPERATES IN A DIFFERENT TIME ZONE.  THE OFFICIAL CLOSING TIME IS SHOWN ON THE RIGHT HAND SIDE OF THE BID SCREEN under the heading of "TIME LEFT".  
  • Payment must be received in Cash or by Cheque prior to removal of the equipment by the purchaser. Cheques must be made payable to the "Thames Valley District School Board" and can be mailed or delivered to The Distribution Centre, 951 Leathorne Street, London, ON, Canada, N5Z 3M7, Attention: Deb Bull.
  • The Board reserves the right to remove any item.
  • Removal of item(s) shall be the sole responsibility of the purchaser. Removal of item(s) must be completed within one (1) week of payment being received by the Board. Any damage to Board property caused by the removal of these items will be charged to the purchaser.
  • The TVDSB is not registered for Provincial Sales Tax, and will not be responsible for the collection of any applicable taxes. Purchasers are responsible to self-assess any applicable taxes.
  • The Auction will be restarted from the beginning in the event of power or internet problems with the Board main server running this site.
  • All items are sold on an " as is " basis, without warranty.  The Thames Valley District School Board will not be liable to repair items sold.
  • There will be no refunds.  The buyer is given adequate time to inspect the items before the auction closes.
  •  The Board makes no warranties whatsoever, either express or implied, oral or written, in fact or by operation of law or otherwise with respect to the goods which are purchased pursuant to this agreement.
  • In particular, the Board and the Purchaser expressly agree that the Purchaser does not rely upon the Board’s skill or judgment in any manner whatsoever, and that the goods are fit for any particular purpose for which the goods are required by the Purchaser, and that the Purchaser is purchasing the goods based on the Purchaser’s own skill and judgment that the goods are fit for the purpose for which the Purchaser intends them to be used.
  • The parties agree that the Board, its officers, directors, and servants shall not be liable to the Purchaser or to any other party for any other liability arising from the use of the goods by the Purchaser, including without limitation, strict liability including liability for any losses or damages including without limitation damages for personal injury, or death, or property damage, economic and consequential losses, or direct or indirect, incidental, exemplary and punitive damages whether in contract, tort, or otherwise, or any claims or expenses in any manner resulting, including without limitation liability, losses, or damages directly, or indirectly, from or connected with the loan or use of the goods.
  • The Board assumes no liability whatsoever with regard to the Purchaser’s compliance or fulfilment of its obligations with respect to any Statute, Regulation, or By-law, prevailing or the Purchaser’s failure to comply or fulfill its said obligations arising out of the Purchaser’s use of the goods.
  • The Purchaser agrees to indemnify and hold harmless and defend the Board from any and all liability for loss, damage and expense which the Board may incur or for which the Board may be held liable by reason of claims by any person for damages causing injury (including death), or damage to any property, or any economic or consequential loss, or direct or indirect, incidental, exemplary or punitive damages arising out of any defect in the goods sold by the Board to the Purchaser including improper inspection, set-up, or use by the Purchaser, whether such claim may arise in negligence or in contract or otherwise, including any such claims against the officers, directors or servants of the Board, including any claims for damages, expenses, including legal expenses incurred in the defence of any such claim, or other expenses of any kind or nature whatsoever asserted against the Board, its officers, directors or servants.
  • The Purchaser agrees that it will reimburse the Board on demand, or pay over to the Board all sums of money which the Board shall pay or become legally liable to pay by reason of any of the foregoing, and will make such payments to the Board as soon as the Board shall become liable therefore, whether or not the Board shall have paid out such sums or any part thereof.
  • The Board shall have the right to demand that the Purchaser, at its sole expense, shall defend any and all actions arising from claims against the Board, its officers, directors and servants, or all of them, against liability, loss, expense, damage, or claim and, upon such demand being made, the Purchaser shall so defend.
 

User Agreement
